These Terms govern your access to and use of FrenchMarketLanterns.com, including all content, functionality, and services offered on or through the Site, whether as a guest or a registered user. By using this Site, you represent and warrant that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference.

We reserve the right to refuse service, terminate accounts, remove or edit content, or cancel orders in our sole discretion. Your continued use of the Site following the posting of revised Terms constitutes your acceptance of such changes.

This Site is intended for use by residents of the United States. We make no representation that materials on this Site are appropriate or available for use in other locations. If you access this Site from outside the United States, you do so on your own initiative and are responsible for compliance with local laws.

You must be at least 18 years of age to use this Site or place an order. By using this Site, you represent and warrant that you are of legal age to form a binding contract and meet all of the foregoing eligibility requirements. If you do not meet these requirements, you must not access or use the Site.

Certain features of the Site may require you to create an account. When you register, you agree to provide accurate, current, and complete information and to update such information as necessary. You are responsible for safeguarding your password and for all activity that occurs under your account. You agree to notify us immediately of any unauthorized access to or use of your account.

We reserve the right to disable any user account at any time if, in our sole opinion, you have violated any provision of these Terms.

All product descriptions, images, and specifications on this Site are provided for informational purposes. Because our copper and gas lanterns are handcrafted, slight variations in finish, patina, and dimensions are inherent to the product and are not considered defects.

Pricing — All prices are listed in U.S. dollars and are subject to change without notice. We make every effort to ensure pricing accuracy; however, errors may occur. If a product is listed at an incorrect price, we reserve the right to refuse or cancel any orders placed at the incorrect price, whether or not the order has been confirmed and your payment method charged.

Order Acceptance — Your receipt of an order confirmation does not constitute our acceptance of your order. We reserve the right to limit or refuse the quantity of items purchased per person, per household, or per order.

Custom & Configured Products — Products configured through our online configurator (powered by ConfigIQ technology) are built to your specifications. Custom-configured lanterns may be subject to different return and cancellation policies as described in Section 5.

Payment Processing & Order Management — Payments on this Site are processed securely through Stripe, a PCI-DSS Level 1 certified payment processor. Order records, fulfillment tracking, and transaction history are maintained in Lagniappe Lighting, LLC's own order-management systems. By placing an order on this Site, you acknowledge that your payment information will be handled by Stripe in accordance with Stripe's Terms of Service and Privacy Policy. Lagniappe Lighting, LLC does not store full payment card information on its own servers.

Alternative Payment Methods — Where offered at checkout, you may pay through PayPal or finance your purchase through Affirm. PayPal payments are processed by PayPal, Inc. and are subject to PayPal's Terms of Service and Privacy Policy. Financing through Affirm is offered by Affirm, Inc., is subject to Affirm's eligibility requirements and credit approval, and is governed by Affirm's terms. Lagniappe Lighting, LLC is not a lender and does not make credit decisions. Availability of any particular payment method is not guaranteed and may change without notice.

Shipping — We ship to addresses within the continental United States. Shipping times and costs are estimated at checkout and may vary based on destination, product weight, and shipping method selected. Risk of loss and title for items purchased from this Site pass to you upon delivery of the items to the carrier.

Returns — Standard (non-customized) products may be returned within ninety (90) days of delivery in their original condition and packaging. Custom-configured products are made to order and are generally non-returnable unless they arrive damaged or materially different from the configuration you approved. To initiate a return, please contact our customer service team. Return shipping costs are the responsibility of the buyer unless the return is due to our error.

Refunds — Approved refunds will be processed to the original payment method within ten (10) business days of our receipt and inspection of the returned item. We reserve the right to charge a restocking fee of up to 25% on eligible returns.

When you visit FrenchMarketLanterns.com, we may collect personal information you provide (name, email, address, payment info), automatically collected data (IP address, browser type, pages visited), device information, and transaction data including product configuration selections.

We use this information to process orders, respond to inquiries, improve the Site, send order confirmations, and with your consent, send marketing communications. We do not sell your personal information to third parties.

We share information only with service providers who assist in operating our Site (such as payment processors, shipping carriers, and ConfigIQ), with law enforcement when required by law, or in connection with a business merger or acquisition.

California residents may have additional rights under the CCPA, including the right to know what personal information is collected and the right to request deletion.

FrenchMarketLanterns.com uses strictly necessary cookies (essential for cart, session, and security), performance & analytics cookies (to understand how visitors use the Site), functionality cookies (to remember your preferences and configurations), and targeting & advertising cookies (to deliver relevant ads and measure campaign effectiveness).

Some cookies are placed by third-party services including Google Analytics, social media platforms, and advertising networks. You can manage cookie preferences through your browser settings. Disabling certain cookies may affect the ability to place orders or use the product configurator.

At this time, the Site does not respond to browser Do Not Track (DNT) signals.

Site content created by Lagniappe Lighting, LLC is protected by U.S. and international copyright, trademark, patent, trade secret, and other intellectual property laws. TheCopperSmith product images and brand assets displayed on this Site remain the exclusive intellectual property of MJ Products, Inc.

We grant you a limited, revocable, non-exclusive, non-transferable license to access and use the Site for personal, non-commercial purposes. If you believe any content on this Site infringes your copyright, please contact us as described in Section 17.

The digital storefront, product configuration tools, and related commerce functionality on this Site are powered by ConfigIQ, a proprietary technology platform licensed to Lagniappe Lighting, LLC. ConfigIQ and its associated trademarks, technology, and intellectual property are the exclusive property of their respective owner(s). No rights to the ConfigIQ technology are transferred to you by your use of this Site.

Functions powered by ConfigIQ technology (including the product configurator, cart, checkout, and order management systems) may be subject to scheduled maintenance or temporary interruptions. Lagniappe Lighting, LLC is not liable for any loss caused by such interruptions. Certain data processed through the ConfigIQ platform is governed by our Privacy Policy as described in Section 6.

Portions of this Site may allow you to submit reviews, comments, photographs, or other content ("User Content"). By submitting User Content, you grant Lagniappe Lighting, LLC a non-exclusive, royalty-free, perpetual, irrevocable, and fully sublicensable right to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such User Content in any media.

You represent and warrant that you own or control all rights to the User Content you submit, that the content is accurate, and that use of the content does not violate these Terms or any applicable law or infringe any rights of any third party.

You agree not to use the Site to: violate any applicable federal, state, local, or international law; transmit defamatory, obscene, fraudulent, or otherwise objectionable material; impersonate any person or entity; engage in unauthorized data collection, scraping, or mining; transmit viruses or other harmful code; attempt to gain unauthorized access to any portion of the Site; interfere with or disrupt the operation of the Site; circumvent security features of the Site; or use the Site for any purpose that is competitive with Lagniappe Lighting, LLC or its brands.

THE SITE AND ALL CONTENT, PRODUCTS, AND SERVICES PROVIDED ON OR THROUGH THE SITE ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

Limitation of Liability: In no event shall Lagniappe Lighting, LLC, its officers, directors, employees, agents, licensors (including ConfigIQ), suppliers, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your access to or use of the Site. In no event shall our total liability to you for all claims exceed the amount you paid to us during the twelve (12) months immediately preceding the event, or one hundred dollars ($100), whichever is greater.

You agree to indemnify, defend, and hold harmless Lagniappe Lighting, LLC, its officers, directors, employees, agents, licensors (including ConfigIQ), suppliers, and affiliates from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising from your use of the Site, your violation of these Terms, your violation of any rights of a third party, or any User Content you submit.

This Site may contain links to third-party websites, services, or content not owned or controlled by Lagniappe Lighting, LLC. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party websites or services. You acknowledge and agree that Lagniappe Lighting, LLC shall not be responsible or liable for any damage or loss caused by use of or reliance on any such third-party content, goods, or services.

These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law principles. Any dispute arising out of or relating to these Terms or your use of the Site shall be resolved exclusively in the state or federal courts located in Montgomery County, Texas.

Arbitration — At our sole discretion, we may require you to submit disputes to final and binding arbitration under the rules of the American Arbitration Association, applying Texas law. Any arbitration shall be conducted on an individual basis and not as a class, consolidated, or representative action.

Class Action Waiver — TO THE FULLEST EXTENT PERMITTED BY LAW, YOU WAIVE ANY RIGHT TO PARTICIPATE IN A CLASS ACTION LAWSUIT OR CLASS-WIDE ARBITRATION AGAINST LAGNIAPPE LIGHTING, LLC.

We reserve the right to modify or replace these Terms at any time in our sole discretion. If a revision is material, we will provide at least thirty (30) days' notice prior to any new terms taking effect by posting the updated Terms on this page and updating the Effective Date. Your continued use of the Site after the effective date of the revised Terms constitutes your acceptance of the changes.
